Out of the 10 witnesses applied by Anwar, only three individuals had the ‘potential’ to be Anwar’s alibi witnesses.
They are Anwar’s driver Abdullah Sani and his two bodyguards, Mokhtar Mustafa and Mohd Khoharullah Abdul Majid.
If it is true the three is Anwar’s alibi, why didn’t he use it during the winding up to determine whether there was a prima facie case?
More questionable, if it is true the three are Anwar’s alibi, why were they not in the CCTV recording of Anwar entering the lift on June 26, 2008?
And also if it is true they are alibi witnesses, why were their names not included in the application by Anwar as among those who needed to be interviewed first before deciding if they would be called as witnesses or otherwise?
What is interesting throughout the interview process, only three of Anwar’s lawyers involved in the case, namely Sankara Nair, Ram Karpal and Param Cumuraswamy were included. Why wasn’t Karpal Singh as the lead counsel present?
Was Karpal not interested in the 15 witnesses? Was it because as a veteran lawyer with vast experience, he knew that the interview process was nothing more than a strategy to delay the proceedings further, and that all 15 of them may not be chosen as witnesses for Anwar?
When Anwar made the application for the 15 to be interviewed, it naturally meant that Anwar’s date for entering his defence on August 8 would have to be postponed to a new date on August 15.
Nevertheless, on August 15, Anwar did not defend himself, instead his lawyers went on to apply for a postponement by saying that the interview process was not complete, hence leaving the court with no other choice than to fix a new date and to give a warning that “whatever the outcome of the interviews, you will have to start defending yourself on August 22.”
